A fee-paying public car park for the parking of private cars, light goods vehicles and light buses currently licensed under the Road Traffic Ordinance (Cap. 374), any regulations made thereunder and any amending legislation (hereinafter referred to as "Fee-paying Public Car Park"). The terms "private cars", "light goods vehicles" and "light buses" shall be as defined in the Road Traffic Ordinance (Cap. 374), any regulations made thereunder and any amending legislation. The decision of the Landlord in determining what constitutes "the Fee-paying Public Car Park" shall be final and binding on the Tenant

A fee-paying public car park for the parking of motor vehicles (excluding (i) franchised buses; (ii) container tractors (with or without trailer attached thereto); (iii) gas vehicles; and (iv) any motor vehicle carrying or laden with any cylinder or container, whether such cylinder or container is empty or not, which is used or to be used to contain liquefied petroleum gas for any purpose other than as the motor fuel for such motor vehicle) currently licensed under the Road Traffic Ordinance (Cap. 374), any regulations made thereunder and any amending legislation (hereinafter referred to as “the Fee-paying Public Car Park”). The terms “gas vehicle”, “cylinder”, “container” and “liquefied petroleum gas” shall be as defined in the Gas Safety Ordinance (Cap. 51), any regulations made thereunder and any amending legislation; and the terms “motor vehicle”, “franchised bus” and “trailer” shall be as defined in the Road Traffic Ordinance (Cap. 374), any regulations made thereunder and any amending legislation. The decision of the Commissioner for Transport as to what constitutes “container tractor” and the decision of the Landlord in determining what constitutes “the Fee-paying Public Car Park” shall be final and binding on the Tenant

Placement of empty skips and parking of skip lorries with empty skips on a fee-paying basis by members of the public and such other ancillary purposes as may be approved in writing by the Director of Environmental Protection. The decision of the Director of Environmental Protection as to what shall constitute "skips", "empty skips" or "ancillary purposes" shall be final and binding upon the Tenant

Plant nursery including the ancillary sale of garden products derived from the Premises. For the purpose of this Agreement, “plant nursery” shall mean a place where plants are propagated and raised for future planting out or sale, and the determination of the District Lands Officer as to whether the Premises or any part or parts thereof is or are being used for the purpose of plant nursery and what constitutes “ancillary sale of garden products derived from the Premises” shall be final and binding on the Tenant

A fee-paying public carpark for the parking of goods vehicles, buses and light buses but excluding (i) trailers and container vehicles; (ii) franchised buses; (iii) public light buses; (iv) gas vehicles (as defined in the Gas Safety Ordinance (Cap. 51), any regulations made thereunder and any amending legislation); and (v) special purpose vehicles. For the purposes of this Agreement, “goods vehicle”, “bus”, “franchised bus”, “light bus”, “public light bus”, “special purpose vehicle” and "trailer" shall have the meanings respectively defined in and be licensed under the Road Traffic Ordinance (Cap. 374), any regulations made thereunder and any amending legislation, and the decision of the Commissioner for Transport as to what constitutes a “container vehicle” shall be final and binding on the Tenant

A steel reinforcing bar prefabrication yard for cutting and bending of steel reinforcing bars, fabrication of reinforcement cages and threading of steel reinforcing bars and coupling with reinforcement connectors together with such ancillary facilities and uses (hereinafter referred to as “the Prefabrication Yard”). The decision of the Director of Civil Engineering and Development as to what amounts to “ancillary facilities and uses” and what constitutes “the Prefabrication Yard” shall be final and binding on the Tenant

For the avoidance of doubt, the processing of materials for recycling (except for steel reinforcing bar wastage generated from the Prefabrication Yard), the storage of steel reinforcing bars for direct supply to purchasers and the production of concrete and/or asphalt or any part of the process of the production of concrete and/or asphalt shall not be allowed. In determining what constitutes “materials for recycling”, “steel reinforcing bar wastage” and “storage of steel reinforcing bars for direct supply to purchasers”, the decision of the Director of Civil Engineering and Development shall be final and binding on the Tenant
